Terms of Use
The terms that apply when you access our website or use ApolloSuite, whether as a customer or as a user granted access by one.
Effective: 14 August 2026
1. Acceptance of these terms
These terms form an agreement between you and 5Lab Group Co., Ltd. Creating an account, signing in, or using any part of ApolloSuite means you accept them. If you do not accept them, do not use the service.
If you accept on behalf of an organisation, you warrant that you have authority to bind it, and “you” in this document means that organisation as well.
2. Definitions
- “Service” means all of ApolloSuite — Apollo CMS, Apollo CIP, and Apollo Commerce — including the APIs, the plugin system, and the documentation.
- “Customer” means the legal entity that contracts with us for the Service.
- “User” means an individual the Customer authorises to access the Service.
- “Customer Data” means data the Customer or its Users bring into the Service, including conversations, contacts, orders, and content.
3. Eligibility and account registration
- You must be at least 20 years old, or of legal age in the jurisdiction that applies to you.
- Information given at registration must be accurate and kept current.
- You are responsible for keeping passwords and authentication factors confidential, and for all activity under your account.
- Tell us without delay if you learn of unauthorised access to an account.
4. Use of the Service and your responsibilities
We grant you a non-exclusive, non-transferable, revocable right to use the Service for your internal business purposes for the term of your agreement. You agree not to:
- Reverse engineer, decompile, or otherwise attempt to derive source code, except as the law permits.
- Sublicense, resell, or operate the Service for third parties in competition with it, without our written consent.
- Upload malicious code, or use the Service to attack any system.
- Circumvent rate limits, quotas, or permission controls.
- Bring in data you have no lawful right to process.
5. Customer Data and data protection roles
Customer Data belongs to the Customer. We claim no ownership of it and use it only to deliver and secure the Service and to follow the Customer's instructions.
In this relationship the Customer is the data controller and we are the data processor. The Customer is responsible for having a lawful basis to collect and use its data subjects' data, and for giving them the notices the law requires. The processing details are set out in our privacy policy and on the sub-processors page.
6. Integrations and external services
The Service connects to messaging channels, payment providers, email providers, and other services the Customer chooses. Those connections use the Customer's own accounts.
- Use of an external service is governed by that provider's own terms and policies, which the Customer is responsible for meeting.
- Some channels require the provider's approval before they can be used, and the provider may suspend or withdraw access at its own discretion.
- We are not responsible for outages, term changes, or account suspensions originating with an external provider.
7. Acceptable use
When you message a recipient through the Service, you must have a lawful basis to contact them and must follow the rules of the channel you are using. Unsolicited commercial messaging, deceptive messaging, and unlawful content are prohibited.
We may suspend sending or restrict access where usage creates a risk to security, to the standing of a connected channel, or to other users. We will tell you where we can.
8. AI features
Output from language-model features is a statistical suggestion. It can be wrong, incomplete, or unsuited to your context. You are responsible for reviewing it before use — particularly messages sent to end customers, pricing information, and anything with legal effect.
We do not warrant the accuracy of model output, and we are not liable for loss arising from acting on it without review.
9. Intellectual property
The Service, its software, documentation, trade marks, and all components are the intellectual property of 5Lab Group or our licensors. These terms transfer no ownership to you.
If you send us product feedback, we may use it to improve the Service without obligation or payment. Such feedback must not include Customer Data.
10. Availability and changes to the Service
We work to keep the Service running, but we do not warrant that it will be uninterrupted or error-free. We may improve, change, or retire features, and we give reasonable notice of changes that materially affect how you use it.
Scheduled maintenance is announced in advance where practical. Emergency maintenance for security reasons may happen immediately.
11. Fees and payment
Fees, billing cycles, and usage limits are set in the quotation or agreement signed in each case. Fees exclude VAT and other taxes required by law unless stated otherwise.
Where an invoice is overdue, we may suspend access after reasonable notice. Fees already paid are non-refundable except where the law requires otherwise or the agreement says so.
12. Suspension and termination
- We may suspend or terminate access on a material breach of these terms that is not cured within the notice period given.
- We may suspend immediately where there is a risk to the security of the system or of other users, or on a lawful order.
- You may terminate as set out in your agreement.
- On termination we provide a means to export Customer Data within the period agreed, after which we delete it under our retention policy.
13. Confidentiality
Each party will keep confidential the other's information that is marked confidential or that should reasonably be understood as confidential, and will not disclose it except to employees and advisers who need to know and are bound to confidentiality, or where the law requires.
14. Disclaimer of warranties
The Service is provided as is and as available. We give no express or implied warranties beyond those the law imposes, including fitness for a particular purpose. This does not affect consumer rights under Thai law that cannot be waived.
15. Limitation of liability
To the extent the law allows, our aggregate liability under these terms is limited to the fees you actually paid us in the twelve months before the event giving rise to the liability.
We are not liable for indirect or consequential loss, lost profit, or data loss arising from factors outside our control. These limits do not apply to liability for wilful misconduct or gross negligence, or to liability that cannot be limited by law.
16. Indemnification
You agree to indemnify and defend us against third-party claims arising from data you bring into the Service, from use in breach of these terms, or from your breach of the law that applies to you.
17. Force majeure
Neither party is liable for delay or failure to perform caused by events beyond its reasonable control, including natural disasters, failures of telecommunications networks or cloud providers, government orders, and similar events.
18. Governing law and disputes
These terms are governed by Thai law, and disputes that cannot be settled are subject to the jurisdiction of the Thai courts. This does not affect a consumer's right to bring proceedings in the forum that consumer protection law provides.
19. Changes to these terms
We may amend these terms from time to time. The effective date above identifies the current version. For amendments that materially affect your rights we give reasonable prior notice, and continued use after the effective date constitutes acceptance.
